Legal victory over the Eldorado Gold Certej gold mine proposal in Romania

27 de septiembre de 2019 – MiningWatch Rumanía tiene el placer de anunciar que la propuesta de la mina de oro Eldorado Gold Certej ha quedado bloqueada. Hoy, el Tribunal de Apelaciones de Cluj confirmó un veredicto pronunciado anteriormente por el Tribunal de Cluj que cancelaba el plan de zonificación urbanístico (PUZ) de la mina propuesta. El veredicto de hoy es definitivo.

“La decisión de hoy invalida todos los actos basados en el PUZ cancelado obtenido por Deba Gold desde 2010 hasta hoy – eso abarca licencias ambientales y licencias de construcción. Para garantizar el cumplimiento, nuestros abogados han compartido hoy la sentencia con las autoridades a nivel local, regional y nacional. Los accionistas de Eldorado deben contar con pérdidas y este proyecto de mina ambientalmente desastroso queda ahora bloqueado indefinidamente”, declaró Roxana Pencea Brădățan, de MiningWatch Rumanía.

Los últimos años, la minera de Certej parecía imparable. Uno a uno, la empresa Eldorado Gold obtuvo nada menos que siete perímetros mineros en el Cuadrilátero Dorado, en las montañas Apuseni de Transilvania. Su intención era fundirlos en una enorme explotación a cielo abierto, utilizando cianuro para separar el oro del mineral. Si su plan hubiera tenido éxito, la explotación y la destrucción inicial serían dos veces mayores del de los proyectos en Rosia Montana.

El PUZ para el proyecto minero Certej fue aprobado por el Consejo Local de Certejul de Sus, mediante la decisión nº HCL 11/2010. Un plano de zoneamiento urbanístico (PUZ) es un conjunto de normas locales que rigen el uso de la tierra y el diseño de objetivos industriales. Lo emite el Consejo Local en beneficio de un operador y, en este caso, en beneficio de un operador de mina.

El veredicto judicial constató que el plano de ordenamiento urbanístico (PUZ)  violando la legislación aplicable de protección ambiental. Esto significa también que todas las autorizaciones obtenidas por Deba Gold a partir de 2010 violan la legislación europea y/o rumana aplicable.

El desarrollo de la mina de Certej está localizado en el municipio de Certeju de Sus en el condado Hunedoara. Es propiedad de Deba Gold SANA, un joint venture entre Eldorado Gold (80%) y la empresa estatal Minvest Deba ( 20%). Eldorado Gold – ELD ( TSX) /EGO ( NYSE) – es una empresa low-cost canadiense de oro que planea abrir la primera mina de oro a cielo abierto que utilizaría cianuro en Rumanía. La altura de ambas presas de relaves sería de 169 m y 70 m, respectivamente, y son una causa adicional de preocupación, pues estarían localizadas en las cercanías de varias aldeas densamente pobladas: Hondol, Bocşa Mică y Certej.

September 27th, 2019 – Mining Watch Network România is pleased to announce that the Eldorado Gold Certej gold mine proposal is blocked. Today the Cluj Court of Appeal upheld a verdict pronounced by the Cluj Court which cancelled the urbanism zoning plan (PUZ) for the entire mine proposal. Today’s verdict is final.

“Today’s ruling invalidates all acts based on the cancelled PUZ obtained by Deva Gold from 2010 to present – this ranges from environmental to construction permits. To ensure compliance our lawyers have today shared the ruling with the authorities at the local, regional and national level. Eldorado shareholders should count their losses and this environmentally disastrous mine project is now blocked indefinitely,” said Roxana Pencea Brădățan from Mining Watch România.

In recent years, the mining operator in Certej seemed unstoppable. One by one, the parent company Eldorado Gold grabbed no less than seven mining perimeters in the Golden Quadrilateral in the Apuseni Mountains of Transylvania. Their intention has been to merge them into one huge open-pit exploitation; using cyanide to separate the gold from the ore. If their plan were to succeed, the exploitation and initial destruction would be double in size than what has been proposed at Roşia Montană.

The PUZ for the Certej mining project was approved by the Certeju de Sus Local Council, via decision No. HCL 11/2010. An urbanism zoning plan (PUZ) is a set of local rules governing land use and the design of industrial objectives. It is issued by the Local Council to the benefit of an operator and in this case, to the benefit of a mine operator.

The court verdict noted that the urbanism zoning plan (PUZ) was issued in violation of applicable environmental protection legislation. This also means that all permits obtained by Deva Gold from 2010 to present were obtained in violation of applicable European and/ or Romanian legislation.

The Certej mine development is located in the commune of Certejul de Sus/ Hunedoara county. It is owned by Deva Gold SA, a joint venture between Eldorado Gold (80%) and the state-owned company Minvest Deva (~ 20%). Eldorado Gold – ELD (TSX) /EGO (NYSE) – is a Canadian low-cost gold company that plans to open the first cyanide-based open-pit gold mine in Romania.The project is facing strong opposition in Romania and beyond. The height of the dams for both tailings ponds would be at 169 m and 70 m respectively, and are an additional cause of concern as they would be located in the immediate vicinity of several densely populated villages: Hondol, Bocşa Mică and Certej.
