Cajamarca: Popular Referendum on mining irresponsibly arranged for Sunday 27th November

COMUNICADO PUBLICO DEL COMITÉ PROMOTOR DE LA CONSULTA POPULAR SOBRE MINERÍA EN CAJAMARCA

El pasado 4 de noviembre el Tribunal administrativo del Tolima aprobó la Consulta Popular de Cajamarca. La decisión fue notificada al Comité Promotor, la Registraduría, el Concejo municipal y la Alcaldía de Cajamarca el día 8 de noviembre. El mandatario local tenía 8 días hábiles para emitir el acto administrativo para fijar la fecha de la Consulta. El alcalde esperó hasta el último día del vencimiento de los tiempos (21 de noviembre) para emitir la fecha de la Consulta Popular, la cual fue definida de manera irresponsable  para el próximo domingo 27 de noviembre.

En relación a lo anterior, el Equipo Promotor de la Consulta Popular de Origen Ciudadano de Cajamarca manifiesta lo siguiente:

  1. La Consulta Popular de Cajamarca es un mecanismo de participación ciudadana consagrado en la Constitución Política de Colombia y un Derecho Fundamental de las Comunidades. Estos procesos deben garantizar que la participación sea efectiva y eficaz, además de ser concertados con el Registrador Municipal. La decisión del alcalde violenta estos preceptos.
  2. La Consulta Popular de Cajamarca es de origen ciudadano, en tal circunstancia el Alcalde debió coordinar con el Comité Promotor de la Consulta Popular de Cajamarca el proceso de convocatoria con el fin de garantizar que el mecanismo se divulgue de manera amplia. Lamentablemente para la democracia colombiana el Alcalde obvio el tema pese a que el Comité Promotor le había solicitado una reunión previa. Pretender realizar la Consulta Popular el 27 de noviembre es un exabrupto dado que  no existen garantías para que la Registraduría pueda realizar el proceso logístico de jurados, testigos electorales, inscripción de equipos promotores, papelería, etc.
  3. La decisión del alcalde desconoce que el derecho sustancial prima sobre el derecho procedimental. Su disposición vulnera el derecho a la participación, impide el desarrollo de una campaña pedagógica y de información sobre el mecanismo de participación ciudadana y violenta las disposiciones de la Corte Constitucional en relación a que estos procesos deben garantizar una participación activa y eficaz.
  4. El Decreto del Alcalde confirma una vez más que al mandatario le disgusta la democracia. La fecha definida sólo favorece los intereses de la empresa minera Anglogold Ashanti. La administración municipal también ha impedido el perifoneo sobre la Consulta Popular en el municipio.
  5. El Comité Promotor de la Consulta hace un llamado a todas las autoridades electorales a garantizar los principios del Estados Social de Derecho, el ejercicio de la democracia, permitir la participación activa, eficaz y el ejercicio de la pedagogía necesaria para el proceso. Solicitamos se haga un control al abuso de poder y actuar desmedido del alcalde de Cajamarca quien de manera deliberada favorece los intereses de la Anglogold Ashanti en contra de sus propios ciudadanos y electores.

In Colombia, popular consultations/referendums on mining have boosted people’s campaigns to decide the future of destructive mining projects. Opposed by many in the government, these processes recently received a boost from the Colombian Constitutional Court, but as the case of Cajamarca shows, without proper consultation democratic participation in referendums is undermined.

PUBLIC STATEMENT OF THE COMMITTEE FOR THE POPULAR REFERENDUM ON MINING IN CAJAMARCA

On 4th November 2016, the popular referendum in Cajamarca was approved by the Administrative Tribunal of Tolima. The decision was sent to the promoting committee, the registration office (la Registraduría), the municipal board and the government of Cajamarca on November 8th. The local representative had 8 working days to send out the administrative act to choose the date of the referendum. The mayor waited until the last day within the accepted time period (21st November) to release the date of the referendum, which was irresponsibly chosen as the following Sunday (27th November).

Considering the above, the Team of the Promoting Committee of the popular referendum of Cajamarca would like to state the following:

  • The popular referendum of Cajamarca is a mechanism for citizen participation written in the political constitution of Colombia and is a fundamental right of the communities. These processes must guarantee that the participation is effective and efficient, and must be in agreement with the head of the local registration office (Registrador Municipal, which in Colombia is an important role involving the assignation of identity documents, the organizing of elections, participation in campaigns etc). The decision of the mayor violates these principles
  • The popular referendum of Cajamarca was founded and formed by citizens. As such, the mayor should have discussed the convocation process with the promoting committee in order to guarantee the wide dissemination of information, as this mechanism dictates. This case is bad news for Colombian democracy, since the mayor failed to follow this procedure, despite the fact that prior to his decision, the Promoting Committee had requested a meeting with him regarding this matter. The calling of the popular referendum on such short notice has been criticized given that there is no guarantee that the registration office will be able to carry out the proper electoral procedure.
  • The decision of the mayor fails to recognize that substantive law (right to participate) prevails over procedural law. This in turn violates the right to participation, prevents the development of a pedagogical campaign and the dissemination of information regarding the mechanism of citizen participation. It also violates the provisions of the Constitutional Court in relation to which these processes must guarantee active and effective participation.
  • The decree of the Mayor confirms once again that the representative dislikes democracy. The defined date favors the interests of the mining company Anglogold Ashanti alone. The municipal administration has also prevented the broader dissemination information about the popular referendum in the municipality.
  • The promoting committee of the referendum calls on all electoral authorities to guarantee the principles of the Rule of Law, the application of the rules of democracy, the realization of active and effective participation and the  carrying out of the pedagogical responsibility necessary for the process. We call for tight regulation against the abuse of power and the unmeasured acts by the mayor of Cajamarca, who deliberately favors the interests of Anglogold Ashanti against his own citizens and voters.
