The National Environmental Movement made a symbolic act on Tuesday, October 2nd, in front of the Palace of Justice in Bogotá with the purpose of asking the Constitutional Court to respect the popular consultations and guarantee the participatory democracy recognized in the Political Constitution of Colombia.
The environmental movement alerted Colombians that the Constitutional Court is reviewing an inadmissible guardianship. “The oil company Mansarovar Energy, which is the plaintiff, did not exhaust the means of judicial defense contemplated in the process of approval of the Popular Consultation of Cumaral, which were opened by the Administrative Tribunal of the Meta region at the time,” explained Renzo García, spokesman of the National Environmental Movement.
Regarding this situation, Garcia added: “It is inadmissible that the new magistrates of the Court want to revert judgments and rights that were already analyzed by the same Full Chamber of the Court, including sentence T445 / 16 and Order 053/17 , through a tutelage that is inappropriate. It is clear that they want to limit democracy and curtail the fundamental right to participation with the aim of imposing mining and oil projects in agricultural territories and affecting strategic ecosystems”.

Dressed up as miners, the environmentalists “cordoned off” the Palace of Justice, displaying a banner with the phrase: “Magistrates captured by the corporations”, to demand the approval of impediments of Magistrates Diana Fajardo and Alejandro Linares, and questioning the denial of impediment of Magistrate Cristina Pardo.
It is to remember that on Wednesday, October 3rd, the Constitutional Court was supposed to have discussed to review the impediments in mention, as the fourth point of their agenda.
Over 100 leaders from all corners of the country -involved in processes related to preventing the arrival of extractive projects in their territories-, met in Bogota concerned about the decision that is in the hands of the Court, which aims to limit the possibilities of participating in the decisions that will affect our future. This is precisely what a democracy is about, that is why this symbolic act was so powerful!
